The Agency Worker Regulations (AWR) came into force on the
1st October 2011, and the act on the whole is over 50 pages long.
In extreme cases, where all clauses of the act are to be
considered, the calculation may extend over 3 years. In
its simplest terms, an agency worker who works any day in a
week for a period of 12 weeks will automatically acquire the
same rights as a full time employee. Although it isn't quite that
straightforward as between every or any pair of weeks, a worker can
be absent for up to six weeks, meaning that in some cases, it
can take up to a year for a worker to gain full time employee
rights. There are also additional periods where the 12 week
accumulation process can be paused or keep running without the
worker being physically present.
