The Agency worker regulations 1st Oct 2011 are complex (50 odd
pages) and calculation may ultimately extend over 3 years of
employment in a worst case scenario. In its simplest terms an
Agency worker who works any day in a week for 12 weeks on the
bounce will accrue sufficient rights to enjoy parity of pay and
conditions with the equivalent substantive full time employee.
However between every and any pair of weeks, an agency worker may
be absent for up to (but not a full) six weeks without interrupting
the accumulation process for the total of 12 weeks. In other words
the without exception twelve weeks can be accumulated over the
course of a year or more. Further, there are additional periods
which may cause the accumulation process to be paused or indeed
keep running without the worker being physically present.
