The Agency worker regulations which came into force on 1st Oct
2011 spans some 50 pages. The fully correct calculation may
ultimately extend over 3 years of employment when all clauses of
the act are taken into account. In a straight forward case an
Agency worker who works any day in a week for 12 weeks
consecutively will accrue the rights that they will enjoy parity of
pay and conditions under law with the minimum equivalent
substantive full time employee. The clauses mean that between every
and any pair of weeks, any agency worker may be absent for up to
six weeks without interrupting the accumulation process of the
total 12 weeks. Put another way, twelve weeks can be accumulated
over in excess of a year. On top of this, there are additional
periods which cause the accumulation process to be pause or keep
running without the worker being physically present.
